1. General Information

The terms "company", "we", "us", and "our" refer to Mind Matters Ltd. The term "site" refers to fastforward.minmatters.pro. The term "member", "user", "you" and "your" refers to clients (including employees, students and other representatives of the client and the client's company or institution) and any other users of the site. The terms "service" and "program" refers to the services included in the Fast Forward Implementation Program (hereafter "Fast Forward") as outlined below.

By participating in the Fast Forward Implementation Program, signing the Fast Forward Course Agreement or accessing the site, you are agreeing to the following terms. These terms apply to all clients and all other users of the site. By using the site or service, you agree to these Terms, without modification, and acknowledge reading them.

In addition, you agree to be bound by all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this School are protected by applicable copyright and trademark law.

2. Use License

You have permission for temporary, non-exclusive use of the site, which allows you to download one copy of any downloadable materials on the site for personal, non-commercial viewing only.

This is the grant of a license, not a transfer of title, and under this license you may not:

  1. modify, copy, duplicate, create derivative works from, frame, record, download or distribute all or any part of the site.
  2. use the materials for any commercial purpose, or for any public display (commercial or non-commerical)
  3. remove any copyright or other proprietary notations from the materials
  4. make the site and/ or any documents or online resources (including downloadable materials) on the site available to any third person
  5. mirror the materials on any other server
  6. republish all or any part of the site

You acknowledge that violating any of these restrictions constitutes a violation of law. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Company at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

You are responsible for configuring your computer and software to access the site content including downloadable files when using our services. We do not warrent that the way we deliver data to you is compatible with your software or configuration of your device.

You must treat all identification codes, passwords and other information you obtain from the use of the site as confidential.

We do not share your details with any third parties and we follow our Privacy Policy in handling information about you. By using the site, you agree to us handling this information and confirm that the data you provide is accurate.

3. Confidentiality

Any and all your information and data of a confidential nature, including, but not limited to any research project, know-how and process information (hereinafter referred to as “confidential information”), shall be treated by us in the strictest confidence and not disclosed to third parties or used by us for any purpose other than for providing you with the services specified in the Course Agreement without your express written consent, other than to comply with law.

Confidential information shall not include any information which

  1. becomes available to the public through no breach of confidentiality by us
  2. was in our possession prior to receipt from the disclosure,
  3. is received by us independently from a third party free to disclose such information, or
  4. is independently developed by us without use of your confidential information.

You agrees to keep confidential any confidential information, as defined in paragraph above, shared by fellow members in the Fast Forward Implementation Program (herein referred to as “members”). Any confidential information shared by members is confidential, proprietary, and belongs solely and exclusively to the member who discloses it.

You agree not to disclose, reveal or make use of any confidential information or any transactions, during discussions, on the Facebook group or otherwise. You agree not to use such confidential information in any manner other than in discussion with other members during the Fast Forward Implementation Program. Confidential information shall not include information rightfully obtained from a third party. You will keep other members’ confidential information in strictest confidence and shall use the best efforts to safeguard the confidential information and to protect it against disclosure, misuse, loss and theft.

You agree to keep confidential any confidential information, as defined above, shared by the company in the Fast Forward Implementation Program. Any confidential information shared by us, our employees or contractors is confidential, proprietary, and belongs solely and exclusively to us. You agree not to disclose, reveal or make use of any confidential information or any transactions, during discussions, on the Facebook group or otherwise. You agree not to use such confidential information in any manner other than in discussion with other members during the Fast Forward Implementation Program. Confidential information shall not include information rightfully obtained from a third party. You will keep our company’s confidential information in strictest confidence and shall use the best efforts to safeguard the confidential information and to protect it against disclosure, misuse, loss and theft.

You shall, during and after the participation in Fast Forward refrain from making any statements or comments of a defamatory or disparaging nature to any third party regarding the company, or any of the company’s officers, directors, employees, personnel, agents, policies, services or products, other than to comply with law.

You agree that if you violate or display any likelihood of violating this paragraph 3 the company and/or the other Fast Forward member(s) will be entitled to injunctive relief to prohibit any such confidentiality violations to protect against the harm of such violations.

4. Disclaimer

The materials on the this site are provided 'as is'. The company makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, the company does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its site or otherwise relating to such materials or on any sites linked to this site.

5. Intellectual Property

We are the owner or licensee of all intellectual property rights in the site in all of the material hosted on the site including any databases that hold relevant information about the site. They are protected by copyright or trademark registration and you may only use any such material and the documents in line with these terms and this paragraph specifically. If you do not use the materials in line with these terms and this paragraph specifically, you lose your right to use our site and must destroy or return any copies of documents you have made of it or any part of it. We reserve all our rights conferred to us by law to remedy any such breach.

In no event shall the company be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the site, even if the company or an authorized of the company has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

The materials appearing on the site may include technical, typographical, or photographic errors. The company does not warrant that any of the materials on its site are accurate, complete, or current. The company may make changes to the materials contained on its site at any time without notice. The company does not, however, make any commitment to update the materials.

10. Governing Law

Any claim relating to the site shall be governed by the laws of the company's home jurisdiction (Malta) without regard to its conflict of law provisions.

If any part of these terms and conditions is held to be invalid or unenforceable, the remaining terms and conditions will continue in full force and effect.
